McGinn Conditional Use Meeting (August 8, 2007)

Meeting called to order at 6:45PM with the Pledge of Allegiance to the Flag.

Chairman, John Pardue advised the purpose of the meeting was for a conditional use request by Robert and Helen McMinn to operate a garden center at 1273 Country Club Road. At which point, Pardue turned the meeting over to the Code Enforcement Officer, Scot Haan.

Haan asked the owners to present their plans. Mr. McMinn stated that he and his wife are in the process of purchasing the farm currently owned by Scott White. There are deed restrictions with this property, therefore, Mr. McMinn presented a letter received from the State of Pennsylvania granting them permission to operate a garden center on this property. The McMinn’s would first like to operate a landscaping business from the property to have display gardens and park equipment. Second, they are looking to operate a garden center to sell trees, mulch, fertilizers, bird feeders, garden tools, patio furniture, Christmas trees, etc. Third, they would like to have a café within the store to sell coffee and such. The owners will not occupy the property but would like to rent the apartment located on the top floor of the barn. Hours of operation vary according to the season. Normal hours would be 8AM to 5PM Monday through Saturday, some nights they would be open 8AM to 8PM during the peak season. They would be open later during Christmas should they decide to sell Christmas trees, Sunday hours would be 11AM to 5PM during the season which would be April 1st to December 30th. The owners are looking at starting the operation May of 2008, but may wait until April of 2009. In the meantime, they plan on restoring the barn/property and installing some of the display gardens. The business requires 35 parking spots and do meet that requirement. Supervisors stated that the apartment being occupied by someone other than the owners requires another conditional use because septic and water concerns would need to be addressed, as well as for the café.

The only public present were Mr. and Mrs. Spangler of 1240 Country Club Road. They offered no comments other than to say they liked what was being said.

Motion by Martenson to approve the conditional use for a garden center to sell trees, shrubs, perennials, annuals, including vegetables, mulch, potting soils and topsoils, fertilizers, seeds, bird feeders, pottery, sculptures, garden tools, gloves, patio furniture, Christmas trees, pond kits, supplies, garden go-withs and seasonal items and landscaping business to have display gardens and parking equipment, 2nd by Koldjeski. Motion voted, all in favor.

Meeting was adjourned at 7:33 PM.
